HAVERSTRAW MAN PLEADS GUILTY TO FELONY GUN POSSESSION, RESISTING ARREST

NEW CITY, N.Y. – District Attorney Thomas E. Walsh II announced that on February 24, 2026, Daquan Kelly, 32, Village of Haverstraw, New York, pled guilty to all charges of Criminal Possession of a Weapon in the Second Degree, Criminal Possession of a Weapon in the Third Degree, and Resisting Arrest, before the Honorable David M. Ascher.

On July 24, 2025, at approximately 11 p.m., the defendant was found to be in possession of a loaded firearm. When he was placed under arrest, he twisted his body, flailed his legs, and threw himself on the ground, refusing to allow himself to be placed into the police vehicle.

The defendant has a lengthy criminal history, including a 2022 conviction for Criminal Contempt in the Second Degree, a 2015 felony conviction for Attempted Robbery in the Second Degree, and a 2012 felony conviction for Robbery in the Third Degree.

Kelly is scheduled for sentencing on June 9, 2026. The People recommended a sentence of 10 years in state prison. The Court is anticipated to impose eight years on the top count of Criminal Possession of a Firearm in the Second Degree, two to four years state prison on the second count of Criminal Possession of a Weapon in the Third Degree, and one year on the third count of Resisting Arrest, all to run concurrently.

“I commend the officers for their vigilance and swift action in taking this individual into custody,” said District Attorney Walsh.

The case was investigated by the Town of Haverstraw Police Department with assistance from the Rockland County Sheriff’s Department.

The case was prosecuted by Executive Assistant District Attorney Michael Peterson.
